Gallerixes is an online store that sells high-quality digital reproductions of public domain artworks. We provide downloadable digital files of classical paintings that have entered the public domain.

2. Definitions

"Artworks": Original paintings whose copyrights have expired and have entered the public domain.
"Digital Reproductions": Digital image files (JPG, PNG, TIFF) that are photographic reproductions or digital scans of Artworks.
"Products": Collectively, the Digital Reproductions offered for sale on our Site.

3. Account Registration

To purchase Products, you may need to create an account. You are responsible for maintaining account confidentiality. You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction).

4. Public Domain Status of Artworks

All Artworks offered on this Site have entered the public domain. Under established legal precedent (including Bridgeman Art Library v. Corel Corp.), a faithful digital reproduction of a two-dimensional public domain artwork doesnot generate a new copyright.

The public domain status of artworks may vary by jurisdiction. You are responsible for verifying the copyright status in your specific jurisdiction before use.

5. License and Permitted Use

Upon purchase, you receive a perpetual, worldwide, royalty-free license to use, modify, and distribute the Digital Reproductions for personal, educational, and commercial purposes.

You agree not to:

Resell or redistribute the original files as a competing product
Misrepresent the source or authenticity
Use in violation of applicable laws
Claim copyright over the unmodified files

6. Purchases and Payments

We process payments through Stripe. Due to the digital nature of our Products, no physical items will be shipped. Download links are valid for 30 days from the date of purchase.

7. Refund Policy

Digital Goods — All Sales Final: Due to the immediate delivery and digital nature of our Products, all purchases are non-refundable and non-exchangeable once payment is completed.

Once your payment is processed, download links are made available immediately. Because digital Products cannot be "returned" in any meaningful sense, we do not offer refunds or exchanges under any circumstances after purchase.

Technical Issues: If you experience corrupted files, incomplete downloads, or format compatibility problems, we will provide a replacement download link at no additional cost. Contact us at support@gallerixes.com for assistance.

EU Consumers: Under EU distance selling law, you have a 14-day right of withdrawal. However, for digital content delivered immediately, this right is forfeited at the moment of purchase, provided you have given your prior express consent and acknowledged that you waive this right. You will see this confirmation before completing your purchase.

8. Intellectual Property

Site content (logo, design, text) is owned by us. Digital Reproductions of public domain works are not subject to our copyright claims.

9. Prohibited Uses

Violate any applicable laws or regulations
Gain unauthorized access to any part of the Site
Use automated tools to extract data without permission
Introduce viruses or malicious code

10. Disclaimer of Warranties

The Site and Products are provided on an "as is" basis. We do not warrant uninterrupted or error-free operation.

11. Limitation of Liability

Our total aggregate liability shall not exceed the amount you actually paid for the Products giving rise to the claim.

We shall not be liable for indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

You agree to indemnify us against claims arising from your use of the Site or Products, or your violation of these Terms.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to suspend or terminate your access at any time without prior notice if you violate these Terms.

15. Disclaimer Regarding Museum Rights

Some museums assert proprietary rights over photographic reproductions of public domain works. We source from collections permitting free use, but cannot guarantee no museum will assert a claim. You use Digital Reproductions at your own risk regarding potential museum claims.

16. Force Majeure

We shall not be liable for failures due to causes beyond our reasonable control, including natural disasters, war, terrorism, or internet failures.

17. Governing Law and Dispute Resolution

Governing Law: Laws of the Netherlands.

Informal Resolution: Contact us first; we respond within 14 days.

Arbitration: Disputes shall be submitted to binding arbitration administered by the Netherlands Arbitration Institute (NAI).

Nothing in this section shall deprive you of the right to bring a claim in your local court as a consumer under applicable local consumer protection laws.

18. Changes to These Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance.

19. Miscellaneous

These Terms constitute the entire agreement. If any provision is found unenforceable, the remainder stays in effect.
